In March, the National Association of REALTORs (NAR) reached a significant settlement, introducing potential changes that could impact the real estate industry starting in the summer of 2024. As your trusted real estate advisor, I aim to be transparent and provide you with a clear understanding of how these changes may affect you as either a home buyer or seller.
Overview of Proposed Changes: 1. Agent Compensation Model - While the agent compensation model is a focal point of the settlement, it's important to recognize that it's just one aspect of the proposed changes. While commissions have always been negotiable, both sellers and buyers will now have more flexibility in how agents are paid. The options may include paying agents a percentage-based fee as traditionally done, or a flat fee or hourly rate. 2. Buyer Representation - A key change introduced by the settlement is the requirement for buyers to have written contracts with their buyer agents. This ensures clarity and transparency in the buyer-agent relationship, empowering buyers to make informed decisions. It’s important for buyers to know that under these new rules they will no longer be able to view any home without an exclusive contract in place with an agent. It’s unclear at this juncture if this includes visiting open houses and if buyers will be required to bring a copy of their buyer agent contract with them. 3. MLS Restrictions - Another significant change is the prohibition of mentioning buyer agent compensation in MLS listings. This restriction aims to reduce perceived potential conflicts of interest, fostering a fair and transparent marketplace for both buyers and sellers. Impact on Sellers Under the proposed changes, a seller will no longer be expected to cover the buyer agent's fee as they have done traditionally. This shift may prompt sellers to reevaluate their compensation strategies when they list their home. While on the surface it may seem like this offers a money-saving opportunity for sellers, it could diminish the buyer pool because some buyers may not be able to afford the added expense. A buyer may end up offering less for the home in this scenario, potentially resulting in a lower sale price for the seller. Impact on Buyers The prospect of the buyer directly covering buyer agent fees could impact their purchasing power and decision-making. Buyers could opt to forego buyer representation altogether by going directly to the seller’s agent because they think it could save them money. However, it's crucial for buyers to understand the importance of having dedicated representation from their own agent. A seller’s agent represents the seller only and cannot offer advice or guidance to the buyer during the transaction. This lack of support for the buyer could cause them to make costly mistakes and for some deals to fall apart because the buyers are not being guided. It goes without saying that this impacts sellers as well. Navigating the Changes: While these proposed changes are not yet official, more information is expected to emerge in the coming months.
